Court reinstates ban on lobster gear to protect right whales

A federal circuit court has reinstated a ban on lobster fishing gear in a nearly 1,000-square-mile area off New England to try to protect endangered whales.
The National Marine Fisheries Service issued new regulations last year that prohibited lobster fishing with vertical buoy lines in part of the fall and winter in the area, which is in federal waters off Maine’s coast. The ruling was intended to prevent North Atlantic right whales, which number less than 340, from becoming entangled in the lines.
The U.S. District Court for the District of Maine issued a preliminary injunction to halt enforcement of the rules. The U.S. Court of Appeals for the First Circuit in Boston vacated that ruling Tuesday.
The circuit court sent the case back to the district court level, but noted in its ruling that it does not think the lobster fishing groups that sued to stop the regulations are likely to succeed because Congress has clearly instructed the fisheries service to protect the whales.
“Although this does not mean the balance will always come out on the side of an endangered marine mammal, it does leave plaintiffs beating against the tide, with no more success than they had before,” the court ruled.
The ruling was the second by a federal court in favor of right whale protection in the past week. A U.S. District judge ruled last week that the federal government hasn’t done enough to protect the whales from entanglement in lobster fishing gear, which can be lethal, and new rules are needed to protect the species from extinction.

Abortion rights protesters rallied in cities around the United States on Saturday, vowing to fight to ensure that abortion remains a legal option for women nationwide.
Hundreds gathered in Chicago, Atlanta, Houston and other cities days after a draft U.S. Supreme Court opinion was leaked to the public suggesting the court is poised to overturn the landmark 1973 Roe v. Wade case that legalized abortion nationwide. The draft opinion, which comes amid nearly 50 years of federal abortion protections, could change before the ruling is finalized in coming weeks.
“To think that, after all this time, people still want to control what women can do and our rights to make our personal healthcare decisions is just really outrageous,” Carole Levin, chair of Courts Matter Illinois, told WMAQ-TV during the rally in Chicago.
Illinois Gov. J.B. Pritzker attended the rally and vowed to protect reproductive rights in Illinois.
“I’m proud Illinois is an island for reproductive freedom in the Midwest,” he said. “Our shores remain open for any person left marooned by these extremist politicians.”
In the nation’s capital, abortion rights protesters stood outside the Supreme Court, holding signs that said abortion is a human right, or “Abort the Court.” Protesters who oppose abortion demonstrated across the street.
In Atlanta, demonstrators carried signs in favor of abortion rights as they marched through that city’s downtown and chanted, “Not the church and not the state, women must decide our fate.”
In Houston, thousands attended a reproductive rights rally headlined by Democrat Beto O’Rourke, who is running for Texas governor. Texas is one of several states that would automatically ban abortion, leaving no exceptions for rape or incest, if the high court overturns the nationwide right to abortion.
An investigation is underway to determine who leaked the Supreme Court draft opinion to Politico.

Man convicted of fraudulently seeking $13M in COVID-19 loans

A Massachusetts businessman has been convicted of fraudulently seeking more than $13 million in federal coronavirus pandemic relief loans, federal prosecutors said.
Elijah Majak Buoi, 40, of Winchester, was convicted Thursday of four counts of wire fraud and one count of making a false statement to a financial institution following a three-day trial in Boston federal court, according to U.S. Attorney for Massachusetts Rachael Rollins’ office.
Prosecutors said Buoi submitted six loan applications through the Paycheck Protection Program but misrepresented the number of employees and payroll expenses for his startup company, Sosuda Tech. He also submitted fraudulent IRS tax forms to support his applications, they said.
The loan program was part of the Coronavirus Aid, Relief and Economic Security, or CARES, Act that allowed qualifying small businesses and other organizations to receive forgivable loans to cover payroll, mortgages, rent and utilities.
Buoi was able to obtain a $2 million loan before he was arrested in June 2020. Rollins’ office said the government has recovered nearly all of the money.

40-year sentence upheld for man who killed his roommate

Maine’s supreme court has upheld a 40-year prison sentence imposed on a man who killed his roommate in Old Orchard Beach.
Dustan Bentley pleaded guilty to murder in the death of 65-year-old William Popplewell, who was beaten, stabbed, and strangled with a ligature.
Police arrested Bentley as he was attempting to use a ratchet and strap to pull the body into the trunk of his car, which was lined with a shower curtain. An autopsy revealed the victim suffered multiple broken bones and had been stabbed up to 30 times.
The Maine Supreme Judicial Court unanimously ruled that there was nothing in the record to indicate that the judge made a mistake.
“At no point did the court depart from sentencing principles or abuse its discretion in coming to or issuing its sentence,” the court said.
Bentley and Popplewell met at a Portland homeless shelter, and Bentley later moved into Popplewell’s apartment in Old Orchard Beach in December 2018. Popplewell was killed in March 2019.
