Woman accused in dismemberment slaying attacks her attorney

A woman accused in a grisly killing and dismemberment case in Wisconsin attacked her attorney Tuesday during a court hearing, moments after a judge agreed to delay her trial.

Taylor Schabusiness, 25, was seated in a Brown County circuit court when her attorney, Quinn Jolly, asked the judge for an additional two weeks for a defense expert to review his client’s competency to stand trial.

Moments after Judge Thomas Walsh reluctantly agreed to postpone her March 6 trial, Schabusiness attacked Jolly and was wrestled to the courtroom floor by a deputy, WLUK-TV reported. The courtroom was then cleared before the hearing resumed.

Schabusiness is charged with first-degree intentional homicide, mutilating a corpse and third-degree sexual assault in the killing of Shad Thyrion, 25, in February 2022. Authorities say she strangled Thyrion at a home in Green Bay, sexually abused him and dismembered his body, leaving parts of him throughout the house and in a vehicle.

Schabusiness has pleaded not guilty and not guilty by reason of mental disease or defect. She is being held on a $2 million cash bond.

Following her courtroom outburst, the judge moved her competency hearing from Tuesday to March 6. The judge also proposed a May 15 trial date.

At the end of the hearing, Jolly told the court he would file a motion to withdraw from the case as Schabusiness’ attorney but the judge did not immediately rule on that matter.

Court rejects appeal to give American Samoans citizenship

The Supreme Court on Monday rejected an appeal seeking to give people born in American Samoa U.S. citizenship.

In leaving in place an appeals court decision, the court also passed up an invitation to overturn a series of decisions dating back to 1901 known as the Insular Cases, replete with racist and anti-foreign rhetoric. Justice Neil Gorsuch had called for the cases to be overturned in April.

But the justices refused to take up an appeal from people born in American Samoa, and living in Utah, who argued that a federal law declaring that they are “nationals, but not citizens, of the United States at birth” is unconstitutional.

A trial judge in Utah ruled in their favor, but the federal appeals court in Denver said Congress, not courts, should decide the citizenship issue. The appeals court also noted that American Samoa’s elected leaders opposed the lawsuit for fear that it might disrupt their cultural traditions.

American Samoa is the only unincorporated territory of the United States where the inhabitants are not American citizens at birth.

Instead, those born in the cluster of islands some 2,600 miles (4,184 kilometers) southwest of Hawaii are granted “U.S. national” status, meaning they can’t vote for U.S. president, run for office outside American Samoa or apply for certain jobs. The only federal election they can cast a vote in is the race for American Samoa’s nonvoting U.S. House seat.

The Insular Cases, which arose following the Spanish-American War, dealt with the administration of overseas territories.

In their conclusion that residents of territories had some, but not all, rights under the Constitution, justices wrote in stark racial and xenophobic terms. Citizenship could not be automatically given to “those absolutely unfit to receive it,” one justice wrote.

That history prompted Gorsuch to comment in a case involving benefits denied to people who live in Puerto Rico, decided in April. He wrote that the Insular Cases were wrongly decided because they deprived residents of U.S. territories of some constitutional rights.


Hong Kongers charged in China plead guilty, relatives told

Relatives of the 10 Hong Kongers accused of fleeing the city by speedboat during a government crackdown on dissent say they've been informed that their family members pleaded guilty, according to a support group.

The families of the detainees were informed by court-appointed lawyers Tuesday that a court in the southern Chinese city of Shenzhen will deliver the verdicts on Wednesday, according to the 12 Hongkongers Concern Group, which is assisting the families.

It was not clear whether the 10 would also be sentenced on Wednesday, but Chinese courts often issue sentences at the same time as verdicts.

The 10 defendants all faced charges of illegally crossing the border, while two of them faced additional charges of organizing the attempt, according to an indictment issued in Shenzhen. The trials began on Monday afternoon, according to a statement issued by the Shenzhen Yantian District court.

Separate hearings were expected for two minors who were also aboard the boat that was apparently heading for Taiwan when it was stopped by the Chinese coast guard on Aug. 23.

The defendants are believed to have feared they would be prosecuted for their past activities in support of Hong Kong’s pro-democracy movement. Hong Kong media reports said at least one may have had a warrant out for his arrest under a tough new national security law imposed on the semi-autonomous territory by Beijing in June.

Relatives of the defendants say that they have been prevented from hiring their own lawyers and that the accusations are politically motivated. The defendants can be sentenced to up to a year in prison for crossing the border and seven years for organizing the trip.

They were picked up after entering mainland Chinese waters for crossing the maritime border without permission. While Hong Kong is part of China, travelers must still pass through immigration when going to and from the mainland. The defendants apparently needed to pass through Chinese waters to get to open seas.
